CONTENT POLICY

1. PURPOSE AND SCOPE

This Content Policy governs the terms of use for content uploaded by users through the Digitable platform and/or generated using artificial intelligence technologies (images, videos, logos, menu descriptions, etc.), the types of prohibited content, and the sanctions applicable in the event of a violation.

The Platform allows users to upload content and generate AI-powered content for the purpose of providing digital menu services for restaurants. Uploaded and generated content is displayed on publicly accessible menu pages.

2. PERMITTED CONTENT TYPES

Only the following types of content may be uploaded to or generated through the Platform:

  • Food and beverage photographs,
  • Restaurant logos and brand images,
  • Menu descriptions and product information,
  • Interior and exterior photographs of restaurants,
  • AI-generated product images and promotional videos,
  • AI-generated or translated menu texts and descriptions.

All uploaded and generated content must be directly related to restaurant operations, of good quality, and representative of reality.

3. PROHIBITED CONTENT

The upload or generation of the following types of content on or through the Platform is strictly prohibited:

  • Sexually explicit, obscene, or inappropriate materials,
  • Images of violence, cruelty, or disturbing content,
  • Content containing hate speech, discrimination, or defamation,
  • Materials infringing copyright or intellectual property rights,
  • Misleading, deceptive, or unrealistic food images,
  • Content that violates applicable laws,
  • Spam, advertising, or content unrelated to restaurant operations,
  • Content promoting alcohol or tobacco products in a manner contrary to applicable legislation.

The Platform has sole discretion in determining whether content is prohibited.

4. PERSONAL PHOTOGRAPHS POLICY

The upload of images containing identifiable individuals is conditional upon the explicit consent of those individuals having been obtained.

The User declares and undertakes that they have obtained the necessary permissions from the individuals appearing in the images they upload. In the event of unauthorised personal photographs being uploaded, the User assumes all legal liability under the KVKK and GDPR.

The Platform reserves the right to remove images found to contain personal data without prior notice.

5. IMAGE RIGHTS AND LICENSING

The User declares and undertakes that all images uploaded to the Platform belong to the User or that the User has the right to use, share, and publicly display such images.

By uploading content, the User grants the Platform a non-exclusive, worldwide licence to display, store, and process such content within the scope of the digital menu service.

The User retains ownership rights over uploaded content and has the right to delete such content at any time.

5.1. Rights to AI-Generated Content

Images, videos, and text generated through AI technologies on the Platform are subject to the terms of use of the relevant artificial intelligence service providers.

The User may use AI-generated content within the scope of the Platform's digital menu service. However, the Company does not guarantee that such content does not infringe third-party intellectual property rights. The User is responsible for monitoring the legality of AI-generated content.

Commercial use of AI-generated content outside the Platform is subject to the licensing terms of the relevant AI providers.

6. CONTENT MODERATION

The Platform has the right to review, inspect, and remove content that violates the Content Policy from uploaded and generated content.

Content review may be carried out at the time of upload and/or subsequently through the following methods:

  • Automated moderation: AI-based content moderation systems automatically check uploaded images for compliance with the policy.
  • Manual review: Company personnel may conduct content reviews in response to complaints or proactively.

The Platform is not under an obligation to pre-screen all uploaded content. However, it reserves the right to take necessary measures against reported or detected violations.

6.1. Moderation During the AI Generation Process

During AI content generation, generated images and videos are checked by automated moderation systems. AI outputs found to be in breach of the Content Policy shall not be delivered to the User, and the related credit charge shall be assessed under the Cancellation and Refund Policy.

7. VIOLATIONS AND SANCTIONS

In the event of a violation of the Content Policy, the Platform may apply one or more of the following sanctions:

  • Removal of the infringing content,
  • Sending a warning notice to the User,
  • Temporary suspension of the User's content upload rights,
  • Permanent closure of the User's account,
  • Initiation of legal proceedings where necessary.

The sanction applied shall be determined according to the nature, recurrence, and severity of the violation.

8. TAKEDOWN PROCEDURE

Third parties may request the removal of content on the Platform that infringes their rights.

8.1. Copyright Infringement Notice

The copyright owner or their authorised representative must provide the following information in an infringement notice:

  • A description of the copyrighted work alleged to have been infringed,
  • The location (URL) of the infringing content on the Platform,
  • The contact details of the applicant (name, address, email, telephone),
  • A declaration of good faith and signature.

8.2. Personal Data Removal Request

Individuals who wish to request the removal of their personal data (including photographs) from the Platform under the KVKK and GDPR may apply together with documents verifying their identity.

Personal data removal requests shall be assessed and concluded within no more than 30 days.

9. AMENDMENTS

This Content Policy may be updated in accordance with legislative changes and/or Platform requirements. Updates shall take effect from the date they are published on the Platform.
